1. About these terms 1.1 This website and the websites of our related businesses (together, the "Site") are owned and operated by and related entities, successors and assigns, and each business or trading name operated by any of them — including Accel Air, A-Temp Heating & Air Conditioning and A-Temp Installations — (together "ASG", "we", "us" or "our"). By using the Site you agree to these Terms of Use, our Website Disclaimer, Privacy Policy and Cookie Policy. 1.2 These Terms of Use govern your use of the Site only. The supply of services and goods is governed by our Customer Terms and Conditions (Service & Installation) and our Terms and Conditions for the Sale and Supply of Goods, which will be provided or referenced when you book or purchase.

2. Quote requests and bookings made through the Site 2.1 Submitting a quote request form, or requesting a quote or booking through our chat assistant, is a request only and does not create a contract. A contract is formed in accordance with our Customer Terms and Conditions when we accept your booking or you accept our quote or estimate. 2.2 You must ensure the information you submit (including contact details, property details and photos) is accurate and that you are entitled to provide it. Information you submit is handled in accordance with our Privacy Policy, including the sections on the quote form, SMS contact and our AI assistant. 2.3 By providing your mobile number, you consent to us contacting you by SMS about your enquiry or booking, and to us replying by SMS when you message us. You can opt out of marketing SMS at any time by replying STOP. See section 6 of our Privacy Policy.

3. AI chat assistant 3.1 The chat feature on the Site (and some of our phone answering) is an AI assistant operated on our behalf by a third-party AI technology provider. You will be interacting with an automated system, not a human, unless you are transferred to our team. 3.2 The assistant's responses are provided for general guidance, triage and booking purposes. They may be incomplete or incorrect, and any pricing indicated is an estimate only until confirmed by our team. Do not use the chat assistant for emergencies. 3.3 Chats and calls handled by the assistant may be recorded, transcribed, reviewed by our staff and used as described in our Privacy Policy. Do not submit sensitive personal information through the assistant.

4. Victorian Energy Upgrades (VEU) offers 4.1 Where the Site describes discounts, rebates or incentives available under the VEU program: (a) all offers are subject to eligibility criteria under the program and to the specific terms stated with the offer; (b) incentive amounts vary with your premises, existing equipment, the product installed and certificate prices, and may change or be withdrawn without notice; (c) in exchange for the discounted price, the Victorian energy efficiency

certificates (VEECs) created by your upgrade are assigned to the relevant accredited provider; and (d) the VEU program is an initiative of the Victorian Government administered by the Essential Services Commission — ASG is not a government agency and our marketing is not an offer made by the government.

5. Finance (humm90) 5.1 The Site may refer to interest-free or other finance options, including humm90. Finance is provided by the relevant third-party credit provider, not ASG. Approval is subject to the provider's lending criteria; terms, conditions, fees and charges apply. ASG does not provide credit or financial product advice, and nothing on the Site is a recommendation that a finance product is appropriate for you.

6. Acceptable use 6.1 You must not use the Site (including the chat assistant and forms) to submit unlawful, misleading, infringing or malicious content; to attempt to gain unauthorised access to any system or data; to scrape or harvest data; to interfere with the Site's operation; or to impersonate any person.

7. Intellectual property 7.1 All content on the Site — including text, images, logos, brand names (Accel Air, A-Temp) and design — is owned by or licensed to ASG and is protected by law. You may view and print content for personal, noncommercial use. You must not otherwise reproduce, modify, distribute or commercially exploit Site content without our written consent.

8. Third-party links and content 8.1 The Site may contain links to third-party websites (including finance providers, manufacturers and social media). We do not control and are not responsible for those sites, and links do not constitute endorsement.

9. Disclaimer and liability 9.1 The Site and its content are provided "as is" for general information. Our Website Disclaimer applies. Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law, we exclude liability for any indirect or consequential loss arising from your use of, or inability to use, the Site.

10. Changes, governing law and contact 10.1 We may update these Terms of Use at any time by publishing the amended version on the Site. Your continued use of the Site constitutes acceptance of the amended terms. 10.2 These Terms of Use are governed by the laws of Victoria, Australia, and the parties submit to the nonexclusive jurisdiction of the courts of Victoria. info@accelair.com.au.
